General Description:

The participant will learn the tools for protecting one’s assets against a future creditor.

Learning Objectives:

After completing this course the participant will be able to:

  • Explain asset protection planning techniques that generally do not work well, such as ­gifting to a spouse.
  • Discuss with clients the limited aspects of exemption planning for a homestead and life insurance.
  • Summarize retirement plan and individual retirement account asset protection planning, including problems with inherited IRAs.
  • Explain to clients the many weaknesses of charging order protection with LLCs and limited partnerships.
  • Discuss ethical considerations and analyze fraudulent conveyance law when preparing an asset protection plan.
  • Employ discretionary dynasty trusts created by a parent or grandparent to protect a child's inheritance.
  • Explain the issues of domestic asset protection trusts when applied to states such as Colorado that do not have an asset protection trust statute.
  • Compare offshore asset protection trusts to domestic asset protection trusts and identify when each would provide a stronger asset protection plan.

Instructors:

Mark Merric is a CPA and an attorney and holds a master of taxation degree. He is an adjunct professor at the University of Denver Graduate Tax Program and the University of Colorado Denver MS in Taxation program, and a lecturer for Fudan University’s Master of Taxation program (second ranked in China). He manages his own law firm where he concentrates on domestic and international business transactions, international taxation, and estate planning. He has spoken nationally and internationally more than 600 times, authored and co-authored more than 80 articles nationally, and is quoted in the Wall Street Journal, Forbes, and the Boston Herald.
